It should be read alongside our Terms and Conditions, Website Terms of Use, Shipping and Delivery Policy, Return and Refund Policy, and Privacy Policy.

2. Nature of Products and Services

2.1 First 5 Minutes Pty Ltd provides digital, online-only products and services, specifically access to online learning courses delivered electronically.

2.2 No physical products are sold, shipped, or delivered by First 5 Minutes Pty Ltd. All access is provided electronically, typically via instant login credentials, download link, or platform access, immediately following successful payment. Delivery method and access duration are set out in our Shipping and Delivery Policy.

2.3 As no physical delivery occurs, standard shipping, freight, and delivery-based terms do not apply to purchases made through the Platform.

2.4 Some purchases may provide multiple course access allocations (e.g., seats, licences, or tokens) that the Client can assign to individual users. Handling of unallocated access is set out in our Return and Refund Policy.

2.5 Free demo or preview course content is made available on the Platform to allow prospective purchasers to review course style, format, and content before purchasing.

3. Consumer Guarantees

3.1 Nothing in this Legal Notice, our Terms and Conditions, our Return and Refund Policy, or any other document excludes, restricts, or modifies any guarantee, right, or remedy conferred on you under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be lawfully excluded.

3.2 Consumer guarantees apply to digital products and services in the same way they apply to physical goods, including that services will be provided with due care and skill, and that products will be fit for the purpose for which they are sold and match their description.

3.3 A distinction is made between a major failure (e.g., course content is corrupted, inaccessible, or materially different from its description) and a minor issue, which may be remedied through alternative means such as re-issuing access.

4. Refunds and Change of Mind

4.1 As our products are digital and access is granted immediately upon purchase, we do not offer "change of mind" refunds once course access has been provided. Where a Client/User has accessed available demo content prior to purchase, this may be taken into account when assessing a change-of-mind request.

4.2 Refunds will be provided where required under the Australian Consumer Law, including where a major failure (as described in clause 3.3) has occurred.

4.3 We do not provide refunds or free replacement access where a course has been incorrectly selected, purchased, or assigned due to user error, as further detailed in our Terms and Conditions.

4.4 As a voluntary term, where a Client is unhappy with the service, we will refund the value of any unallocated course access remaining on a multi-seat purchase. Access already allocated to a user remains valid and usable regardless of whether it has been used or completed. Full detail, including the refund request process, is set out in our Return and Refund Policy.

5. Pricing and GST

5.1 All prices displayed on the Platform are in Australian Dollars (AUD).

5.2 Prices are exclusive of GST where applicable, and are in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth). GST treatment of refunds is set out in our Return and Refund Policy.

5.3 We reserve the right to vary prices at any time. Price changes will not affect purchases already completed.

6. Payment Processing and Security

6.1 Payments made through the Platform are processed via Stripe, a third-party payment gateway that maintains PCI-DSS (Payment Card Industry Data Security Standard) compliance.

6.2 First 5 Minutes Pty Ltd does not directly store full credit card details. Payment information is handled securely by our payment processor in accordance with applicable industry standards.

6.3 Disputes and chargebacks should be raised with us directly in the first instance, as set out in our Return and Refund Policy, before being escalated to your card issuer or payment provider.

8. Electronic Transactions

8.1 By completing a purchase on the Platform, you agree that the transaction is conducted electronically and that this is valid and binding in accordance with the Electronic Transactions Act 1999 (Cth).

8.2 Records of your purchase (including confirmation and receipt) will be provided electronically and constitute a valid transaction record.

9. Electronic Communications and Marketing

9.1 Where we send you marketing or promotional communications by email, we do so in accordance with the Spam Act 2003 (Cth), including obtaining consent, clearly identifying the sender, and providing a functional unsubscribe mechanism in every message.
